Overview and acceptance
This website is operated by Furvibe. Throughout these Terms, “Furvibe,” “we,” “us” and “our” refer to the business that operates this website, and “you” refers to anyone who visits the site or places an order. Our store runs on Shopify, which provides the e-commerce platform we use to sell our products to you.
By accessing this site or placing an order, you agree to these Terms of Service (“Terms”) and to the policies they reference, including our Privacy Policy, Shipping Policy and Return & Refund Policy. If you don’t agree, please don’t use the site.
Eligibility and accounts
You must be at least 18 years old, or the age of majority where you live, to place an order. By using this site, you confirm that you meet this requirement and that the information you give us is accurate, current and complete.
If you create an account, you’re responsible for keeping your login details confidential and for all activity under your account. Please let us know promptly if you believe your account has been used without your permission.
Our products and pet safety
We choose our products for everyday use by pets in the care of a responsible adult. Every pet is different, so please use good judgment and follow these guidelines:
- Supervise. Always supervise your pet with a new product, especially at first, until you’re confident in how they use it.
- Choose the correct size. Use the measurements and sizing guidance on each product page, and choose the size that suits your pet’s breed, weight and habits.
- Inspect regularly. Check products for wear, damage or loose parts. Remove and replace any item that’s damaged. No product is indestructible.
- Follow instructions. Follow any care, use and safety instructions provided with the product or on its product page.
Our products are not veterinary products or medical devices, and they are not intended to diagnose, treat, cure or prevent any condition. Please consult your veterinarian about any concerns regarding your pet’s health, behavior or diet.
Product information and colors
We work hard to describe and photograph our products accurately. Colors can look different depending on your screen, and textiles and natural materials can vary slightly from piece to piece. Dimensions and weights are approximate.
We don’t warrant that product descriptions, images or other content on the site are complete, current or free of errors. If a product isn’t as described, your remedy is to return it under our Return & Refund Policy.
Pricing, availability and errors
All prices are shown in U.S. dollars. Prices, products and availability can change without notice, and we may limit quantities or discontinue products at any time.
Occasionally, an item may be listed with an incorrect price, description or availability. We reserve the right to correct any error and to cancel orders affected by it, even after an order has been placed. If we cancel an order for this reason, we’ll let you know and refund any amount charged in full.
Promotions and gift cards
Discount codes and promotions are subject to the terms shown with them. They have no cash value, can’t be combined unless stated, and may be changed or ended at any time. Gift cards are non-returnable and can’t be redeemed for cash, except where required by law.
Orders and acceptance
When you place an order, you’re making an offer to buy. The confirmation email we send means we’ve received your order; it doesn’t yet mean we’ve accepted it. We accept your order when we dispatch it.
We may refuse or cancel any order, for example if a product is unavailable, if there’s an error in pricing or product information, or if we suspect fraud or an unauthorized transaction. If we cancel an order after you’ve been charged, we’ll refund you in full to your original payment method.
Payment and taxes
Payment is taken when you place your order. Payments are processed securely through Shopify’s checkout and its payment partners, and we don’t store your full card details. The payment methods we accept are shown at checkout.
By submitting payment, you confirm that you’re authorized to use the payment method. Applicable sales tax is calculated and shown at checkout before you pay.
Shipping, returns and refunds
Shipping and delivery are governed by our Shipping Policy. Returns, exchanges, refunds and cancellations are governed by our Return & Refund Policy. Both form part of these Terms.
In short: we ship within the United States, standard shipping is free on orders of $75 or more, and you have 30 days from delivery to return eligible items. Risk of loss passes to you when your order is delivered to the shipping address you provided.
Privacy
Your use of this site and any personal information you share with us are governed by our Privacy Policy. You can review and manage your choices at any time on our Your Privacy Choices page.
Intellectual property
The content on this site, including text, photography, graphics, logos and the Furvibe name, is owned by or licensed to us and is protected by intellectual property laws. You may view and print pages for your personal, non-commercial use. You may not copy, reproduce, modify, distribute or use any of this content for commercial purposes without our written permission.
Feedback and submissions
If you send us comments, ideas, suggestions, photos of your pet or other materials, you grant us a non-exclusive, royalty-free, worldwide and perpetual license to use, reproduce and display them in connection with running and improving our business. We’ll always ask your permission before featuring a photo of you or your pet.
You’re responsible for anything you submit. It must be your own, must not infringe anyone else’s rights, and must not be unlawful, misleading, abusive or harmful. We aren’t obligated to use, keep or respond to any submission.
Third-party links and services
Our site may link to, or rely on, third-party websites and services, such as payment providers and shipping carriers. We don’t control and aren’t responsible for their content, products or practices. Please review their terms and privacy policies before using them.
Prohibited uses
You agree not to use this site or its content:
- For any unlawful purpose, or to encourage others to act unlawfully.
- To infringe our intellectual property rights or the rights of others.
- To harass, abuse, threaten or discriminate against anyone.
- To submit false or misleading information, or to place fraudulent orders.
- To upload or transmit viruses or any other malicious code.
- To scrape, crawl or collect data from the site by automated means without our permission.
- To interfere with or get around the security features of the site.
- To impersonate any person or business.
We may suspend or end your access to the site if you violate these restrictions.
Disclaimer of warranties
Except as expressly stated in these Terms or required by law, this site and all products and services offered through it are provided “as is” and “as available,” without warranties of any kind, express or implied. To the fullest extent permitted by law, we disclaim all implied warranties, including warranties of merchantability, fitness for a particular purpose and non-infringement.
We don’t guarantee that the site will be uninterrupted, secure or free of errors. Nothing in this section limits your rights under our Return & Refund Policy or any rights you have under consumer protection laws that cannot be excluded.
Limitation of liability
To the fullest extent permitted by law, Furvibe and its owners, employees, suppliers and service providers will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any lost profits, revenue or data, arising from your use of this site or any product purchased through it. This includes harm arising from unsupervised use, incorrect sizing, misuse, or continued use of a worn or damaged product.
Our total liability for any claim relating to a product or to your use of this site is limited to the amount you paid for the product that gave rise to the claim. Some jurisdictions don’t allow the exclusion or limitation of certain damages, so some of these limits may not apply to you.
Indemnification
You agree to indemnify and hold harmless Furvibe and its owners, employees, suppliers and service providers from any claim, demand, loss or expense, including reasonable attorneys’ fees, made by a third party arising from your breach of these Terms, your violation of any law, or your violation of the rights of a third party.
Severability
If any part of these Terms is found to be unlawful, void or unenforceable, that part will be enforced to the fullest extent permitted by law, and the remaining parts will stay in full force and effect.
Termination
These Terms apply until they are ended by you or by us. You can end them at any time by no longer using the site. We may end them, or suspend your access to the site, if we reasonably believe you’ve failed to comply with them. Any orders placed before termination, and any provisions that by their nature should continue (including those on intellectual property, disclaimers, limitation of liability, indemnification and governing law), will survive.
Governing law
These Terms, and any separate agreements under which we provide you products or services, are governed by the laws of the United States and of the state in which Furvibe’s business is registered, as listed on our Contact page, without regard to conflict-of-law principles. Nothing in these Terms limits any consumer protection rights you have under the laws of the state where you live.
Informal dispute resolution
If you’re ever unhappy, we’d like the chance to put it right. Before bringing any formal claim, please contact us through our Contact page with your name, your order number (if any), a description of the issue and the outcome you’re looking for. We’ll both work in good faith to resolve it informally within 60 days.
If we can’t resolve it within that time, either of us may bring the matter before a court of competent jurisdiction in the state identified in the Governing law section above, or in a small claims court where the claim qualifies. This doesn’t prevent you from contacting a government consumer protection agency at any time.
Changes to these Terms
We may update these Terms from time to time. The “Last updated” date on this page shows when they last changed. Updates apply from the date they’re posted and don’t affect orders placed before then. Continuing to use the site after an update means you accept the revised Terms.
